Tian Kai is a disputes lawyer whose practice includes court litigation, international arbitration and mediation. He advises clients in the avoidance, management and resolution of their disputes across a wide range of areas including construction and engineering, equity and trusts, restructuring and insolvency, commercial financing and other contractual or corporate disputes.

Effectively bilingual in business English and Mandarin, Tian Kai has acted for and against Chinese state-owned enterprises (SOEs), as well as in relation to projects based in Taiwan and Hong Kong. He also represents clients from Korea, Japan, the Middle East and Europe, across various sectors from construction, mining and natural resources to financial services, private equity, logistics and telecommunications, media and technology (TMT).

  • Representing multiple sellers in an SIAC arbitration and related proceedings in respect of a post-M&A dispute with the purchaser over breaches of warranties and earn-out payment obligation.
  • Represented a holding company with substantial mining interests in Asia in an ICC arbitration against its investor for breaches of an investment agreement.
  • Acting for an international contractor against its local subcontractor in relation to works for a power plant in East Asia.
  • Acted for a renowned international contractor to pursue claims in connection with an oil field project in the Middle East.
  • Successfully obtained an award for an owner of telecommunications infrastructure against a major telecommunications operator for the lease of telecommunications towers and sites in a Southeast Asian country.
  • Advised project companies and sponsors in relation to claims from their contractors arising out of the design and construction of offshore wind farms in Asia.
  • Acted for a high net worth individual on a complex claim for breach of trust over disputed assets valued at between US$600 – 800 million with cross-border aspects in Hong Kong, among others.
  • Advised an established private equity fund on its strategy and options to enforce its CIETAC arbitration award across multiple jurisdictions.
  • Acted for the Prosafe group of companies in its US$1.1 billion debt restructuring under the supervision of the Singapore Court, which also involved cross-border recognition proceedings in multiple jurisdictions.
  • Advised a trustee to various series of Sukuk bonds in relation to a high-profile judicial management proceeding in the Singapore High Court.
