In the recent case of PP v Aishamudin bin Jamaludin [2020] SGCA 70, the Court of Appeal was asked to decide whether the Prosecution could charge two accused persons on the basis of a common intention between them but bring a more serious charge against one accused person and a less serious charge against the other. The Court of Appeal described these as “differing common intention charges”.
 
The Court of Appeal considered what amounts to running an inconsistent case, particularly in the context of differing common intention charges, and laid out an approach to determine whether the Prosecution has brought inconsistent charges against two or more accused persons.
