Benjamin is a commercial disputes and employment lawyer with experience across all levels of the Singapore courts and in international arbitration.
He maintains a broad disputes practice, acting across a wide spectrum of matters, including shareholder disputes and property-related litigation.
As an employment specialist, Benjamin’s employment practice encompasses the full spectrum of advisory and contentious matters. He advises on employment considerations in mergers and acquisitions, workplace safety and health compliance, and trade union and foreign manpower issues. He also advises on workplace investigations, disciplinary proceedings, retrenchment exercises, terminations and wrongful dismissals, and the enforcement of post-employment restrictive covenants.
Employment litigation
- Acted in the recent landmark decision of Prashant Mudgal v SAP Asia Pte Ltd [2026] SGHC 15, which affirmed the implied term of mutual trust and confidence in Singapore. The judgment is notable for its careful articulation that a breach of the implied term is not a licence to claim damages that fail to pass the contractual principles of causation and remoteness. Benjamin acted for the employer and successfully reduced the employee’s claim of around S$5 million to nominal damages.
Workplace liability
- Acted for Underwater World Singapore in dealing with workplace safety and health breaches after its diver was killed by a stingray, and successfully obtained a lower sentence after mitigation.
Commercial litigation
- Acted successfully before the Court of Appeal for a medical company in its claim for breaches of fiduciary duties, conspiracy, and breaches of confidence: Centre for Laser and Aesthetic Medicine Pte Ltd v GPK Clinic (Orchard) Pte Ltd [2018] 1 SLR 180.
- Successfully obtained urgent interim injunctions to restrain the sale of an international vessel worth around S$8.6 million in the context of a shareholder dispute.
Property-related litigation
- Acted before the High Court and the Court of Appeal for the objectors to the collective sale of a property known as Goodluck Garden: Lim Hun Joo v Kok Yin Chong [2018] SGHC 256; Lim Hun Joo v Kok Yin Chong [2019] SGHC 3; Kok Yin Chong v Lim Hun Joo [2019] 2 SLR 46.
