Overseas witness unwilling to travel to Singapore granted leave to testify via video link

The Court of Appeal recently held in Anil Singh Gurm v JS Yeo & Co and another [2020] SGCA 5 that an overseas witness’s unwillingness to travel, by itself, is not determinative of an application for leave for the witness to testify via video link.
A witness’s unwillingness to travel to Singapore, while a weighty consideration against remote testimony, may be displaced upon a holistic assessment of the circumstances of each case.
