A “Patent’s Bargain”: How an insufficiency attack on certain claims in a patent may in turn cause a patentee to lose his entire patent

In IIa Technologies Pte Ltd v Element Six Technologies Ltd [2023] SGCA 5, a matter concerning the technology of lab-grown diamonds, the Court of Appeal held that where the person skilled in the art is unable to determine whether a particular product or process is within or outside the scope of the claim, the sufficiency requirement in section 80(1)(c) of the Patents Act is not satisfied.
