To use or not to use… Documents obtained in court proceedings – A framework for cases involving the Riddick principle

In the recent judgment of Jane Rebecca Ong v Lim Lie Hoa and other appeals and other matters [2021] SGCA 63, the Court of Appeal reversed the High Court’s decision and granted leave for the Appellant to use affidavits filed by one of the Respondents in examination of judgment debtor proceedings, in subsequent proceedings against that Respondent for breach of duties he allegedly owed to the estate of the late Mdm Lim Lie Hoa.
