The Malaysia Competition Commission Consults on Draft Guidelines on Abuse of Dominance

The Malaysia Competition Commission (“MyCC”) has, on 15 May 2012, commenced its public consultation on its draft guidelines on Chapter 2 of the Competition Act 2010 (“Act”) relating to abuse of dominance (“Draft Guidelines on Abuse of Dominance”). The Draft Guidelines on Abuse of Dominance deal with two key aspects as set out below.

• Determination of whether an enterprise is “dominant”
• Determination of whether a dominant enterprise is engaging in an “abuse”
