High Court allows an undertaking from litigation funders to serve as security for costs

In the decision of Hyflux Ltd (in compulsory liquidation) and others v Lum Ooi Lin  SGHC 113, the Singapore High Court was faced with the issue of whether an undertaking from the plaintiffs’ litigation funders could constitute an adequate form of security for costs. On the facts of the case, the Court held that plaintiffs were not restricted to any fixed form of security for costs.
