Directors Tony Yeo and Yuen Kit Kuan have co-authored the Singapore chapter of Reputed Trade Marks and Their Protection, published as part of the AIPPI Law Series.
The book provides a comparative analysis of the legal protection afforded to trade marks whose reputation gives them value beyond their traditional function as indicators of origin. In today’s global and digital economy, reputed marks can carry significant commercial value, with their protection potentially extending beyond the traditional principles of specialty and likelihood of confusion to issues such as dilution, tarnishment and unfair advantage. This broader protection, however, also raises difficult questions about the proper limits of trade mark rights and their relationship with competition, market access and freedom of expression.
Drawing together detailed country-specific studies, the publication examines how different jurisdictions approach key issues surrounding reputed marks, highlighting both common principles and important differences in their protection.
