Directors Benedict Teo and Tham Feei Sy co-authored the Singapore chapter of Banking Litigation, in the Lexology In-Depth, Edition 7 (formerly The Law Reviews).

The guide provides analysis of global legal issues and their commercial implications, written by thought leaders at the world’s top law firms.

In the Singapore chapter, Benedict and Feei Sy focused on recent developments and trends pertaining to banking litigation. The chapter examines:

(a) recent banking cases relating to an issuing bank’s obligation to pay under a letter of credit, circumstances in which a joint bank account may be garnished and when an accelerated payment clause and default interest rate under a loan may be unenforceable penalties;

(b) the impact of legislative and regulatory developments, as well as changes to court procedure;

(c) sources of potential litigation; and

(d) other issues relating to interim measures, privilege and professional secrecy, jurisdiction and conflicts of law, as well as exclusion of liability clauses, and more.
