This discussion will focus on the inputs and outputs, covering topics such as permissions for use of data to train the AI model, and ownership over its output. It aims to address questions (from the point of view of an organisation deploying the AI solution) such as:
- What can I do to protect myself if my developer uses copyrighted material to train the AI model?
- Can my developer use the data I give them to train the model for other customers' benefit?
- Who owns the output?
To ground the discussion, we will first look at the current legal developments around the world on using copyrighted material to train generative AI models, liability for copyright-infringing generative AI output, as well as ownership over AI-generated output. We will also discuss some sample clauses relating to indemnities, warranties and assignment of rights in the AI-generated output.
