UK Supreme Court Abolishes Experts’ Immunity from Suit

The UK Supreme Court, the UK’s highest court, has abolished the immunity from suit for breach of duty that experts have enjoyed in relation to their participation in legal proceedings.

There are no reported cases on experts’ immunity in Singapore. However, UK cases are referred to as persuasive authority in appropriate circumstances.

Experts should therefore be aware that they could potentially be liable to their clients for a breach of duty (whether in contract or negligence) even in situations where the work relates to preparation for or involvement in legal proceedings.
