The Malaysia Competition Commission Announces Quantum of Fees for Exemption Applications Under the Competition Act

It was reported that the Malaysia Competition Commission (“MyCC”) announced on 27 April 2012 that a RM50,000 (S$20,400) fee would be payable for parties seeking to make an application for an exemption. In addition to the one-time application fee, parties who successfully obtain an exemption will have to pay an annual fee of RM10, 000 (S$4,100) for those under individual exemptions, or RM20,000 (S$8,200) for those under block exemptions.

The Malaysia Competition Act 2010 (“Act”) provides that companies may apply to MyCC for relief from section 4 of the Act (against anti-competitive agreements), under an individual or block exemption. It appears that MyCC has supplemented the details in its draft guidelines (which merely state that a “prescribed fee” would be payable for those seeking to apply for an exemption), with the announcement of the quantum of fees via the media on 27 April 2012.
