Law of Incorporation Generally Applies to the Question of Whether Corporate Veil Should Be Lifted

In the recent decision of Nicholas Eng Teng Cheng v Government of the City of Buenos Aires [2024] SGCA 15, the Court of Appeal held that as a general rule, the law of incorporation should apply to the question of whether the corporate veil should be lifted.
 
The Court of Appeal also noted that the applicable law may not necessarily be the law of incorporation in all cases, and that the Court retains the discretion to apply the law of the forum or another more appropriate law if the interests of justice render it necessary to do so.
