Grounds for Curial Intervention in Arbitration Proceedings are Narrowly Circumscribed

The decision in COT v COU and others and other appeals [2023] SGCA 31 is a notable example of how non-signatories to a contract may find themselves bound by an agreement to arbitrate therein.  The case also raises interesting questions of the degree to which there can be de novo review by the Courts, if the challenge to the validity of an agreement to arbitrate is based on an alleged lack of authority by the person who concluded the agreement on one party’s behalf.
