Director Desmond Chng was recently featured in Asian Legal Business (ALB) on Singapore’s upcoming Workplace Fairness Act. In the article, he shared insights into how employers can navigate these changes while maintaining both legal compliance and operational efficiency.
He shared that employers should conduct a comprehensive review of their employment policies and practices to ensure compliance with the upcoming Workplace Fairness Act and the Tripartite Guidelines on Fair Employment Practices across all stages of employment.
Desmond noted that recruitment has been identified as the stage where most workplace discrimination occurs. Employees should ensure that job listings and advertisements only state reasonable job requirements, such as language proficiency, and avoid language that may indicate a preference against any protected characteristics. Selection criteria should also be based on merit and relevant to genuine and reasonable job requirements, and should be applied in a consistent and fair manner.
If it becomes necessary to explain decisions that may be perceived or challenged as discriminatory, Desmond said that having consistent and contemporaneous documentation of employment decisions will be key in addressing discrimination claims.
With the Workplace Fairness Act mandating that all employers must have a grievance handling process, Desmond recommended that employers should have a strict policy against retaliation so that employees are assured of a safe channel to raise grievances without fear of negative repercussions.
