The digital economy in ASEAN is currently valued at over $300 billion and is expected to exceed $1 trillion by 2030 with significant growth in areas such as e-commerce, digital financial services and online media. Data transfers, including those involving personal data, are expected to play a significant role in facilitating this growth and organisations operating across ASEAN should be aware of legal and regulatory requirements relating to such transfers including, in particular, requirements relating to protection of personal data and management of data breaches. This series of webinars by Drew Network Asia features speakers from around the ASEAN region who will share their perspectives on how organisations can better address their legal and regulatory obligations and cyber risks in a cross-border context.
Vietnam’s regulatory landscape has undergone significant development with the introduction of its comprehensive personal data protection framework, most notably under the Law on Personal Data Protection and its implementing decree – Decree 356. This framework establishes detailed rules governing the collection, processing, and transfer of personal data, including stringent consent requirements, enhanced data subject rights, and clear obligations relating to data security and breach notification. Cross-border transfers of personal data are subject to specific conditions, such as the preparation of impact assessments and, in certain cases, regulatory filings with the competent authorities. The regime also imposes heightened responsibilities on data controllers and data processors, including the implementation of robust technical and organizational measures to protect personal data, as well as obligations to detect, respond to, and promptly report data breaches.
In our fifth and final webinar of the series, we shall look at issues relating to management of cross-border data transfers and data breaches between Singapore and Vietnam. This session will also cover recent practices and enforcement trends by regulators in Vietnam.
