Revisiting Legitimate Interest

Legitimate interests was introduced into the Personal Data Protection Act (PDPA) in 2021 as a new, general basis for organisations to collect, use and disclose personal data without the consent of the individuals concerned. Recent enforcement decisions by the Personal Data Protection Commission (PDPC) highlight situations where legitimate interests would be the most appropriate, if not the only, basis for organisations to rely upon to collect and use personal data. In particular, this may include situations where organisations require individuals to provide personal data for a purpose and hence cannot obtain their freely-given consent for collection of the data. This webinar considers when an organisation may wish to rely on legitimate interests as the basis for collecting, using and disclosing personal data and the requirements they must satisfy under the PDPA in order to do so.
