Length of cohabitation prior to marriage is irrelevant in the assessment of division of matrimonial assets

In the recent judgment of USB v USA and another appeal [2020] SGCA 57, the Court of Appeal held that in determining the length of the marriage and assessing parties’ indirect contributions to the marriage for the purposes of division of matrimonial assets, the court should not consider the period of time when parties were cohabiting with each other prior to the marriage.
