The Intellectual Property Office of Singapore (IPOS) has announced its plans to move away from the current patent regime to a positive grant system.
The existing patent regime is a “self-assessing” one whereby the applicants bear the onus of ensuring that a patent application meets the patentability requirements of novelty, inventive step and industrial applicability. Hence, even if an unfavourable search and/or examination report is issued for a patent application, the application could still proceed to grant.
In the new system envisaged, only patent applications with fully positive examination reports issued (ie. applications which fully meet the patentability criteria) will be granted.
Gerald Koh, a Director of our IP department, will bring you through these changes and the possible implications arising from them.
Rozalynne Asmali, an Associate Director of our IP department, will then discuss some of the latest patent infringement cases in Singapore.
Benjamin Gaw, a Director from our Corporate & Finance department, will round up the seminar with a discussion on issues relating to negotiating IP commercial agreements, with a focus on patent-related agreements, such as research and collaboration agreements and patent licensing agreements.

Gerald Koh, Director
Gerald is a Director in the Intellectual Property Department. He has almost 14 years of legal experience and holds a Specialist Diploma in Molecular Biotechnology.
He specialises in contentious and non-contentious IP matters. His practice includes registration and enforcement of patents and designs. He also handles IP management for local enterprises and renowned global corporations. Gerald is very active in IP licensing, acquisitions, and due diligence projects.
Gerald serves on the Intellectual Property Office of Singapore’s (IPOS) committee for the Patent Agent Qualifying Examination and is an Exco member of the International Association for the Protection of Intellectual Property (AIPPI) Singapore.
Benjamin Gaw, Director
Benjamin is a Director in the Corporate & Finance department, and regularly advises numerous companies in the technology, biotechnology, health and pharmaceutical industries on a range of corporate, regulatory, and employment issues in Singapore, including advising on Traditional Chinese Medicine regulations and advertisement laws and regulations, reviewing and drafting clinical trial agreements, research and development agreements, licensing agreements and franchise agreements and advising on all aspects of employment matters, including employment agreements, secondment arrangements, and termination of employees.
Rozalynne Asmali, Associate Director
Rozalynne is an Associate Director and her principal areas of practice are general commercial litigation and intellectual property litigation. She assists in various litigation cases involving contractual disputes and intellectual property disputes. In addition to contentious matters, Rozalynne also handles non-contentious intellectual property matters.
