This seminar will discuss the widespread implications for commercial entities and lawyers arising from the Court of Appeal’s landmark decision in HSBC Institutional Trust Services (Singapore) Ltd (as trustee of Starhill Global Real Estate Investment Trust) v Toshin Development Singapore Pte Ltd [2012] SGCA 48, where the Court upheld an agreement between the parties to negotiate in good faith. Drew & Napier successfully acted for Toshin both before the High Court and the Court of Appeal.
